Effective January 1, 2021 

This Privacy Notice applies only to the Services, and the collection, use, disclosure, and protection of your information in relation to the Services. It does not apply to third party websites, applications, or services.

If you have questions about The Rainbow Club of South Georgian Bay / Collingwood Pride or practices, or if you need to contact us about the information we collect about you, our contact information is at the end of this Privacy Notice. 

Information Collection and Use

Collingwood Pride collects various types of information when you access, use, or interact with the Services. The information about you is collected in three ways: directly from your input, from third-party sources, and through automated technologies. The types of information Collingwood Pride may collect include:

Personally Identifiable Information: Collingwood Pride may collect Personally Identifiable Information about you through your use of the Services. “Personally Identifiable Information” refers to information about you that may be used to identify you, such as your: first name, last name, address, zip code, email address, or phone number. We may combine the Personally Identifiable Information we collect with additional information we collect about you or obtain from third-party sources. Collingwood Pride may use your Personally Identifiable Information to inform you of other products or services available from Collingwood Pride and its affiliates. 

You are not required to provide your Personally Identifiable Information; however, if you choose to withhold certain Personally Identifiable Information, we may not be able to provide you with certain of the Services. 

Collingwood Pride Account Information: Collingwood Pride may require you to register for an account in order to use certain Services. We do not require that you register or provide personal information to view many of our Services. However, if you do register, you will have access to certain areas of the Services that require registration.  Collingwood Pride may collect information about you in connection with your registration for your Collingwood Pride Account, which may include Personally Identifiable Information and other information such as a username, password, personal profile, pictures, your location, and information about your contacts. Please be aware that some of your Collingwood Pride Account information may be displayed publicly. 

Payment Transaction Information: You may provide certain information to complete payments via the Services, including your name, address, credit or debit card number, card expiration date, CVV code, and billing address (collectively, “Payment Information”), along with your delivery or shipping address, to complete payment transactions through certain of our Services. We consider the Payment Information we collect from you private and will not make such information public. We may collect and store information related to your purchases made through our Services.

Correspondence Information: If you email us, subscribe to our newsletters or mailing lists, or purchase products or services through the Services, we may keep your message, email address, and contact information to respond to your requests, provide the requested products or Services, and to provide notifications or other correspondences to you. We do not share or sell any personal information to other organizations for commercial purposes.

Public Information: Collingwood Pride may collect information about you from publicly available sources. Information you make publicly available in any public or open forum, such as on a social network, may be considered public information for the purposes of this Privacy Notice, and may be accessed and collected by Collingwood Pride. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Services is nether private, nor confidential. Collingwood Pride is not responsible for any content or information you post or share with third parties.

Information We Collect Automatically:

Links: Collingwood Pride may keep track of how you interact with links across the Services, including our email correspondences, third-party services, and client applications. We do this to help analyze the use of and improve the Services. Link information is generally only analyzed on an aggregate basis.

Unique Identifiers: When you use or access the Services, we may access, collect, monitor, store on your device, and/or remotely store one or more "Unique Identifiers," such as a universally unique identifier (“UUID”). Unique Identifiers are small data files or similar data structures stored on or associated with your device that uniquely identify your device, whether or not you establish a Collingwood Pride Account. A Unique Identifier may be data stored in connection with the device hardware, in connection with the device's operating system or other software, or via data sent to the device by Collingwood Pride. A Unique Identifier may convey information to Collingwood Pride or to a third party partner about how you browse and use the Services and may help us or others provide reports or personalized content and advertisements. A Unique Identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Services. You can typically change your browser settings to disable use or availability of Unique Identifiers. Some features of the Services may not function properly if use or availability of Unique Identifiers is impaired or disabled.

Log File Information: When you use our Services, we may receive log file information such as your IP address, browser type, access times, domain names operating system, the referring web page(s), pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive log file data when you interact with our Services, for example, when you visit our websites, sign into our Services, or interact with our email notifications. Dawn uses log file data to provide, understand, and improve our Services, and to customize the content we show you. Collingwood Pride may link this log file to other information Collingwood Pride collects about you via the Services. 

Information Use and Sharing

Collingwood Pride will not share, sell, rent, or otherwise disclose your private personal information to third parties without your consent, except in the limited circumstances described in this Privacy Notice.

Service Providers: Collingwood Pride works with various organizations and individuals to help provide the Services to you ("Service Providers"), such as hosting companies, payment processors to process payments, or companies that provide analytics information, like Google Analytics. We may share your personal information with our Service Providers for the purpose of providing the Services. The information we share to our Service Providers may include both information you provide to us and information we collect about you, including Personally Identifiable Information, Payment Information (to our payment processing providers only), information from data collection tools like cookies, web beacons, log files, Unique Identifiers, and location data. Collingwood Pride will take reasonable steps to ensure that our Service Providers are obligated to reasonably protect your information on Collingwood Pride’s behalf. If Collingwood Pride becomes aware that any Service Provider is using or disclosing information improperly, we will take commercially reasonable steps to end or correct such improper use or disclosure.

Lawful Requests: We may be required to disclose User information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We generally do not disclose User information unless we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. We may share your information when we believe it is necessary to comply with applicable laws, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Services or using the Collingwood Pride name, or to protect the safety of any person. This may include sharing information with other companies, lawyers, agents, or government agencies. Nothing in this Privacy Notice is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Legal Basis for Processing Personal Information (EEA visitors only)

If you are a visitor from the European Economic Area, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only (i) where we need the personal information to perform a contract with you, (ii) where the processing is in our legitimate interests and not overridden by your rights, or (iii) where we have your consent to do so. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.

If we ask you to provide personal information to comply with a legal requirement or to perform a contact with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information).

If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our platform and communicating with you as necessary to provide our services to you and for our legitimate commercial interest, for instance, when responding to your queries, improving our platform, undertaking marketing, or for the purposes of detecting or preventing illegal activities. We may have other legitimate interests and if appropriate we will make clear to you at the relevant time what those legitimate interests are.

Users Data Protection Rights

Access to the Information Collingwood Pride Has Collected About You

Collingwood Pride provides certain tools and settings within the Services to help you access, correct, delete, or modify the personal information you provided to us and associated with your account. In addition, Collingwood Pride welcomes you to contact us regarding the information we have collected about you, including regarding the nature and accuracy of the data Collingwood Pride has collected about you or to request an update or deletion of your information. Please note that if you choose to delete your information or opt-out of the collection and use of your information, certain features and Services may no longer be available to you.

Opting-Out of Communications From Collingwood Pride

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from Dawn by contacting us at info@collingwoodpride.com. You may unsubscribe from email communications from us by clicking on the "unsubscribe” link provided within the communication. You may not, however, opt-out of Services-related communications, for example, account verification, purchase and billing confirmations and reminders, changes or updates to features of the Services, or technical and security notices.

Collingwood Pride may employ third party advertising and marketing to deliver ads, information, and other promotions to you, both through the Services, and via other mechanisms to provide such materials to you outside of the Services on third party websites or platforms. Users may opt-out of receiving any or all communications from Collingwood Pride by contacting us at Web-info@collingwoodpride.com. Dawn may compile and release information regarding you and your use of the Services on an anonymous basis as part of a customer profile or similar report or analysis. You agree that it is your responsibility to take reasonable precautions in all actions and interactions with any third party you interact with through the Services.

Other Rights for EEA Visitors

If you are a resident of the European Economic Area, you have the following data protection rights:

  • In addition, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Again, you can exercise these rights by contacting us using the contact details provided under the “How to contact us” heading below.
  • If we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

Data Retention

We may store the information we collect about you, but information generally will be retained only for as long as necessary to fulfill the purposes for which the information was collected, or as otherwise required by law. 

Information Security

Security of Your Information

Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password and Collingwood Pride account, and are fully responsible for all activities that occur under your password or Collingwood Pride Account. Collingwood Pride specifically reserves the right to terminate your access to the Services and any contract you have with Collingwood Pride related to the Services in the event it learns or suspects you have disclosed your Collingwood Pride Account or password information to an unauthorized third party.

Data Security Incidents

In the event that any information under our control is compromised as a result of a breach of security or other data security incident, Collingwood Pride will take reasonable steps to investigate the situation and where necessary, notify those individuals whose information may have been compromised (where appropriate) and take other steps in accordance with applicable laws and regulations. We are not responsible for the functionality, privacy, or security measures of any other organization.

Changes to Our Privacy Notice

The Services that Collingwood Pride provides are always evolving and the form and nature of the Services may change without prior notice to you. Collingwood Pride may modify this Privacy Notice at any time. We may also notify you of changes to the Privacy Notice, particularly if we deem the changes to be material. By continuing to access or use the Services after changes become effective, you agree to be bound by the revised Privacy Notice
